Representatives of Nobuaki Kobayashi, the lawyer appointed trustee in the MtGox liquidation proceedings recently commenced in Japan, have asked the court handling MtGox’s U.S. Bankruptcy to grant approval so that they can forward at their end.
The request was made to Judge Jernigan of the Dallas court handling the case. Jernigan set a June 17 hearing to determine if the company will be granted bankruptcy protection. There is still no guarantee that this will happen.
Karpeles’ lawyers have requested that protection be granted as their client offers his input from abroad via deposition. Jernigan had refused their request, saying, “If he avails himself of this court, my God, he is going to get himself over here”. One U.S. lawyer suggested Karpeles would be arrested should he set foot on U.S. soil.
Another potential obstacle may be the recent “settlement” in the ongoing lawsuit against MtGox, reached upon by a consortium of stakeholders including Sunlot Holdings, a number of MtGox customers and former management of the Exchange who were among defendants in the suit.
As touched upon on Tuesday, the filing of bankruptcies and lawsuits in multiple jurisdictions over what can turn out to be an overlapping pool of assets is likely to trigger complications by inter-dependencies which are likely to arise.
